New Mexico Background Check Laws: What Employers Need to Know
New Mexico sets reporting limits on criminal history and applies Ban-the-Box rules to public sector hiring, relevant across the state's energy, aerospace, and healthcare industries, whether you're hiring in Albuquerque, Santa Fe, or Las Cruces.
Reporting Time Limits
Pending cases, indictments, and arrests are reportable for 7 years, but once a case is completed without a conviction, it can no longer be reported. In practice this means only pending matters remain reportable among non-conviction records. Convictions are reportable for 7 years from the date of release or parole. Pardoned convictions can't be reported at all.
Public Employer Ban-the-Box
State, city, and county agencies can't ask about convictions on an initial employment application, and can only consider a conviction after the candidate has been selected as a finalist. Public employers also can't consider arrests without a conviction, records that have been sealed, dismissed, expunged, or pardoned, juvenile adjudications, or convictions unrelated to the job. This applies to public employers, not private ones.
Social Media Password Protections
Employers can't request or require a prospective employee to provide a password for a social networking account, or demand access to that account in any other manner.
Security Freeze Notice
When a consumer reporting agency is required to send a summary of rights under the FCRA, New Mexico requires an additional state notice covering consumer rights around security freezes.
