Nevada Background Check Laws: What Employers Need to Know

Nevada has a distinct reporting structure for criminal convictions, plus a set of employer-facing rules around credit reports and applicant privacy, relevant across the state's gaming, hospitality, and tourism industries, whether you're hiring in Las Vegas, Reno, or Henderson.

Reporting Time Limits

Bankruptcies older than 10 years generally can't be reported. As of 2015, criminal convictions are no longer subject to a 7-year reporting limit in Nevada, though non-convictions and civil judgments still are. Nevada also runs a two-tier salary structure: there's no general salary cap, except for the gaming industry, which follows a $75,000 threshold under a specific state adoption of the federal FCRA's high-earner exception.

Credit Reports

Employers generally can't refuse to hire, promote, or take adverse action against a candidate who declines to allow a credit report where one isn't permitted. A credit report can only be requested when it's required by federal or state law, or reasonably related to the position, with the state maintaining a non-exclusive list of qualifying roles.

Sex Offender Registry Data

Employers can't use information from the state's community notification sex offender website for any employment-related purpose.

Social Media Password Protections

Employers can't directly or indirectly require an applicant or employee to disclose login credentials or other access to their social media accounts, broadly defined to include email, messaging, blogs, and online profiles.
